General Terms and Conditions of Sale and Use – Car Parks

1. Purpose – Scope

These General Terms and Conditions (GTC) govern access, use, pricing and payment of the car parks operated by Bergerac Dordogne Périgord Airport (“the Airport”). Accessing the car park constitutes full acceptance of these GTC by the user.

2. Nature of the service – Unsupervised car park

The car parks are paying and unsupervised. The Airport does not monitor vehicles or belongings and declines any liability in case of loss, theft, damage or deterioration, except in cases of proven fault of the Airport.

3. Access – Entry/Exit procedure

  • Entry: ticket collection and/or use of a subscription support (card or license plate recognition depending on equipment).
  • The barrier allows only one vehicle at a time; “tailgating” is prohibited.
  • Exit: prior payment required at automatic pay stations (indoor and outdoor). Assistance may be provided by authorized staff in case of incident.

4. Traffic and safety rules

  • Compliance with Highway Code and internal signage.
  • Maximum speed: 20 km/h. Maximum authorized height: ≤ 2.80 m (light vehicles).
  • Prohibited: buses, heavy vehicles, oversize vehicles, motorhomes, caravans, trailers (unless prior written authorization).
  • Parking prohibited on roadways, marked areas, reserved spaces (PRM, taxis, VTC, rentals, services) or in front of emergency exits.

5. Rates – Payment – Invoicing

  • Applicable rates displayed at entrances, pay stations and published on the website.
  • Payment at automatic pay stations (indoor/outdoor); accepted means depending on equipment.
  • Duplicate subscription card: €25.00 incl. VAT (payable upon issue).
  • Lost ticket: €180.00 incl. VAT (payable before exit).
  • Professionals: invoicing possible upon request (aeroport-bergerac@bergerac.aeroport.fr).

6. Non-subscribers

Parking charged per duration according to the posted tariff. In absence of valid proof for a lost ticket, application of the “lost ticket” flat rate of €180.00 incl. VAT before exit.

7. Long-term subscriptions – Special conditions

7.1 Nature of the right

Right of access during validity period, without reservation of a numbered space. Subscription is personal and non-transferable. Only one vehicle may enter/exit at a time per subscription.

7.2 Independence from flight schedules

Parking subscriptions are independent of flight schedules. No refund or discount in case of cancellation, suspension or modification of flights (any cause).

7.3 Unavailability attributable to the Airport (works, closure)

When unavailability attributable to the Airport makes usage impossible, the subscription is extended pro rata temporis (or a credit note for equivalent duration issued if immediate technical extension is not possible). No cash refund.

7.4 Commercial gesture (capped)

Exceptionally: flat extension of one month, once per holder, upon written request, without creating precedent.

7.5 Subscription card – Loss/theft/damage/defect

Immediate declaration for blocking. Duplicate: €25.00 incl. VAT (regardless of cause). Re-issue irreversibly deactivates old card and does not extend subscription.

7.6 Transfer / license plate change

Plate change possible (€25.00 incl. VAT fee) upon request and confirmation; nominative, non-transferable and without extension of subscription.

8. Anti-fraud – Irregular parking – Removal

Fraud/evasion (tailgating, duplication/lending of support, intrusion): settlement at due rate, penalty €250.00 incl. VAT per event, deactivation of support/subscription.

Dangerous/obstructive or reserved parking: fine, removal/towing at owner’s risk and expense, invoicing for possible repairs.

9. Damages – Declarations – Liability

Any incident caused by the user must be reported immediately. The user is liable for damages caused to persons, property or equipment.

9.1 Vehicle deemed abandoned – Procedure

Vehicle deemed abandoned after 45 days without movement (outside valid subscription) or 15 days after subscription expiry without renewal. Procedure: formal notice, then removal/towing by authorized contractor. All costs borne by the owner.

10. Service suspension – Force majeure

The Airport may temporarily suspend access for safety, maintenance or works. Force majeure events release the Airport from liability and give no entitlement to compensation.

10.1 Exceptional closure / public order

In case of closure imposed by authority or justified by public order/safety: no compensation. For subscriptions, only the pro rata rule in §7.3 applies if unavailability is attributable to the Airport.

11. Personal data

Processing required for parking management (access control, LPR/ANPR, subscriber management, payment, anti-fraud). Data controller: Bergerac Dordogne Périgord Airport. Legal bases: contract performance / legitimate interest / legal obligations.

11.1 Data processed

Identification data, license plate/ANPR, subscriber IDs, access logs, payment references (excluding card number storage), CCTV images in/around car parks.

11.2 Retention periods (standard)

  • ANPR / access logs: 30 days rolling.
  • CCTV: 30 days rolling (unless requisition/investigation).
  • Subscriber file: contract duration + 5 years.
  • Billing / accounting: 10 years.
  • Technical security traces: up to 12 months.

11.3 Recipients

Authorized staff, contractors (parking/payment/hosting), insurers, legal auxiliaries; authorities upon legal requisition.

11.4 Security

Appropriate measures: authorization, encrypted flows (TLS), encryption at rest if relevant, logging, segmentation, backups. No transfers outside EU without safeguards.

11.5 Rights & DPO

GDPR rights: access, rectification, deletion, objection, restriction, portability. DPO contact: aeroport-bergerac@bergerac.aeroport.fr — postal: DPO – Bergerac Dordogne Périgord Airport, Route d’Agen, 24100 Bergerac. Response within 1 month (extendable by 2). Complaint possible with CNIL.

12. Claims – Consumer mediation

13. Governing law – Disputes

French law applies. In absence of amicable solution or mediation, jurisdiction lies with the territorially competent courts, subject to public policy rules.

14. Publicity – Amendments – Entry into force

GTC displayed at entrances and pay stations, and published on the website. The Airport may amend the GTC at any time; applicable version is the one in force at the date of parking entry or subscription purchase/renewal. This version supersedes and replaces all previous versions.

15. Reference language

An English version may be published for information purposes. In case of discrepancy, the French version prevails.
